In 1978, California voters passed Proposition 8, a constitutional amendment that allows for a temporary reduction in assessed value when a property experiences a "decline-in-value." This occurs when the current market value of your property is less than its assessed value as of January 1 of that year.

Under California State Law (Prop. 13), the maximum amount your assessed value can be increased is 2% annually. Unfortunately, the CPI and property values often move in different directions and at different rates. Under Proposition 8, you are entitled to a temporary reduction in your assessed value if the market value falls below the trended base year value. An appeal under Proposition 8 is called a Decline in Value Appeal. The only way to protect your right to a corrected assessment is to file an appeal every year you think you may be over-assessed.

If you disagree with the Assessor's assessment, you can appeal it to the Assessment Appeals Board by filing an Assessment Appeal Application (AAB). The AAB is an independent body established to resolve valuation disputes between the Assessor’s Office and property owners.

However, filing the application does not exempt you from paying your taxes on time. To avoid penalties, ensure you pay your taxes as they become due. If you have already paid your property taxes for the current tax year and the Assessor lowers the assessed value, you will receive a refund.
